Federal Investigation Targets Gov. Phil Murphy and AG Platkin Over Immigration Policy

A federal investigation has been launched into New Jersey Governor Phil Murphy and Attorney General Matt Platkin, focused on the state’s 2018 Immigrant Trust Directive — a policy that limits how local law enforcement engages with federal immigration agencies such as ICE.

The announcement came directly from Interim U.S. Attorney for New Jersey, Alina Habba, during an appearance on Fox News. Habba, a recent appointee of President Donald Trump and a former member of his legal team, stated:

“I have instructed my office today to open an investigation into Governor Murphy and Attorney General Platkin.”

The Immigrant Trust Directive, still in effect and previously upheld by the courts, prohibits state and local police from inquiring about immigration status or cooperating with ICE in most circumstances.


Murphy and Platkin Respond

In response, Governor Murphy defended the directive, calling it a necessary measure to ensure community safety:

“We’re not in the immigration business. If we need to work with federal immigration authorities, we absolutely do,” Murphy said in an interview on the MeidasTouch podcast.

Attorney General Platkin also pushed back on the probe, noting that the directive was upheld by the Third Circuit Court of Appeals in 2021. He stated:

“I don’t typically launch investigations on cable news networks. I’m focused on doing my job, which is to keep the residents of our state safe.”


 What Charges Could Be on the Table?

Legal experts say it’s too early to know if any charges will be filed. However, if the case moves forward, here’s what Governor Murphy and AG Platkin could possibly face:

  • Obstruction of Federal Law Enforcement – For allegedly hindering ICE operations.

  • Violation of Federal Immigration Law – If the directive is interpreted as interfering with federal duties.

  • Misuse of Public Office – Should prosecutors argue the policy was politically motivated over public safety.

Still, most experts caution that the directive was legally vetted and has a strong chance of holding up under scrutiny.
